Rio de Janeiro by Cariocas Travel – Terms & Conditions of Use

This document governs the use of riodejaneirobycariocas.com and all services offered by Rio de Janeiro by Cariocas Travel (“we,” “us,” or “our”).

Please read carefully before making any booking or using our website.
These Terms apply to all users and customers, except where otherwise stated.

This document is written in English for the convenience of our international clients. In the event of any discrepancy, the Portuguese version shall prevail.

1. Our Contract

All bookings are made with Rio de Janeiro by Cariocas Travel.
By making a booking, the traveler (“you”) agrees to these Terms & Conditions on behalf of all individuals included in the booking.
The services to be provided are those listed in your booking confirmation.

No amendment or variation to these Terms will be valid unless made in writing by an authorized representative of Rio de Janeiro by Cariocas Travel.

2. Pricing and Payments

2.1 Pricing

a) Prices and exchange rates — All prices are quoted in the local currency at the prevailing exchange rate determined by Rio de Janeiro by Cariocas Travel.

b) Price changes — Prices displayed on our website are current and subject to change without notice. Once a booking is confirmed, the price is fixed and will not increase or decrease.

c) Per person — Unless stated otherwise, all prices are per traveler.

d) Inclusions — Prices include all items and services expressly listed in the tour or experience description on our website.

e) Exclusions — Prices do not include personal expenses, travel insurance, tips or gratuities, meals and beverages not specified, or any local taxes and fees unless explicitly mentioned.

f) Taxes and Fees — All applicable taxes, processing, and bank fees are included in the final price, unless otherwise stated.

g) Discounts — Promotional or seasonal discounts may be offered and are subject to specific conditions.

2.2 Children’s Policy

To ensure a safe, comfortable, and enjoyable experience for all travelers, our children’s policy works as follows:

a) Children up to 2 years old  Children under 2 years old (up to 1 year and 11 months) join free of charge on tours operated directly by Rio de Janeiro by Cariocas, provided they do not require an individual seat.

b) Tours operated by third-party suppliers For experiences operated by third-party suppliers (such as boat tours, helicopter flights, etc), the supplier’s own children’s policy will apply.

c) Rules regarding minimum age, seating, safety equipment, and pricing may vary depending on the supplier.

d) Tickets and children’s discounts Children’s discounts for tickets are defined by each attraction individually and may vary according to age, date, and local regulations.

e) We always follow the official policy of each attraction and confirm applicable discounts at the time of booking.

2.3 Payment

a) Payment methods — Payments are processed securely via Stripe or other authorized processors.

b) Due date — Payment for private tours is due upon confirmation of your itinerary, unless otherwise agreed in writing.

c) Currency conversion — If your bank account or card uses a different currency, the total charge will be converted at your card issuer’s applicable exchange rate.

3. Cancellations, Amendments & Force Majeure

3.1 Cancellations by the Traveler

All cancellation requests must be sent by email to sales@riodejaneirobycariocas.com. Refunds are processed as follows:

  • 7 days or more before the tour: No cancellation fee.
  • 6 to 3 days before the tour: 50% cancellation fee. If payment has been made in full, a 50% refund will be issued, less any non-refundable upfront costs (e.g., tickets, partner deposits, or transaction fees).
  • Less than 48 hours (2 days) before the tour: 100% cancellation fee; no refund applies.
  • Supplier-operated tours: If a third-party supplier operates your tour, their cancellation policy will apply.

Brazilian customers purchasing remotely are entitled to a full refund within seven (7) calendar days of purchase, in accordance with Article 49 of the Brazilian Consumer Protection Code, provided that the service has not already been performed.
If the booking is made less than seven days before the tour start date and the service has been rendered, the right of withdrawal does not apply.

3.2 Cancellations by Rio de Janeiro by Cariocas

We may cancel a tour prior to departure if, due to terrorism, natural disasters, political instability, or other extraordinary external events, it becomes unsafe or unfeasible to operate the planned itinerary. If such cancellation occurs, you may choose between:

  • a full refund of all amounts paid, or
  • transferring your booking to an alternative date or experience of equal value (subject to availability).

In these cases, no administrative or cancellation fees will be withheld. However, Rio de Janeiro by Cariocas Travel will not be responsible for incidental expenses not booked through us — such as independent flight tickets, visas, or travel insurance — that may be affected by the cancellation.

3.3 Amendments by the Traveler

Changes to existing bookings may require cancellation and rebooking under the then-current rates. Cancellation charges may apply.

3.4 Amendments by Rio de Janeiro by Cariocas

We strive to operate tours as advertised but reserve the right to modify itineraries, transportation, or stops when necessary.
Significant changes will be communicated as soon as reasonably possible.

4. Confirmation and Vouchers

Upon receipt of full payment, you will receive a digital voucher by email.

The lead traveler must present this voucher to the guide at the start of the tour.

Failure to do so may result in service denial without refund.

5. Traveler Responsibilities and Conduct

5.1 Timeliness

Tours depart punctually. Please arrive at least 10 minutes before the start time indicated on your voucher.

Our team will wait for a maximum of 15 minutes from the scheduled start time or from the guide’s arrival at the agreed meeting point or pickup location. After the 15-minute waiting period, we reserve the right to consider the service a no-show, with no possibility of refund.

Please note that tours or experiences involving third-party suppliers, tickets, or attractions with scheduled entry times (such as trains, cable cars, monuments, events, or other timed services) are subject to the specific policies and regulations of those establishments. In such cases, late arrival may result in denied entry or loss of the service, without refund, in accordance with the supplier’s rules.

Failure to appear at the meeting point or pickup location within the applicable waiting time, without prior notice and/or formal confirmation from our team, will be considered a no-show and is non-refundable.

5.2 Conduct

You are responsible for your own behavior and that of your party.
We reserve the right to remove any traveler whose conduct endangers others, disrupts the tour, or offends local communities.
No refunds will be provided in such cases.

5.3 Compliance

You must comply with all local laws, customs, and regulations of the destinations visited.
Vaccination certificates or entry documents required by local authorities are the traveler’s responsibility.

5.4 Acceptance of Risk

By booking, you acknowledge that travel involves inherent risks.
You may visit areas where political, health, or environmental conditions differ from your daily life.

You voluntarily assume such risks and release Rio de Janeiro by Cariocas from liability, except in cases of fraud or gross negligence.

6. Accuracy of Information

You are responsible for providing accurate personal and logistical information. Incorrect or incomplete data (e.g., wrong hotel or email) may result in service denial without refund.

7. Age and Health Requirements

Travelers under 18 must be accompanied by a responsible adult.
Some tours may have age or fitness requirements; please review the tour description before booking.

It is your responsibility to ensure you are physically capable of participating safely.

8. Travel Insurance

We strongly recommend all travelers obtain comprehensive travel insurance, covering medical expenses, personal accidents, trip cancellations, and delays.

Rio de Janeiro by Cariocas and its partners are not liable for losses resulting from inadequate insurance coverage.

9. Passports and Visas

It is your responsibility to hold valid travel documents. Your passport must be valid for at least six months beyond the tour date. We are not responsible for denied entry due to missing or incorrect visa documentation.

10. Complaints

If an issue arises during your tour, please inform your local guide immediately so it can be resolved.
If you are not satisfied, send a written complaint to sales@riodejaneirobycariocas.com within 30 days after travel.
Complaints received after this period may not be considered.

11. Photos and Marketing

We may request your consent to use photos or videos taken during tours for promotional purposes.

By agreeing in writing or via digital consent, you grant us a non-exclusive, royalty-free, worldwide license to use such images for marketing purposes.

12. Blog and User Interaction

12.1 Sponsored and Affiliate Content

The Rio de Janeiro by Cariocas Blog may include:

  • Sponsored articles (clearly identified);
  • Press invitations without payment;
  • Affiliate links that may generate commissions.
    All advertising complies with FTC (U.S.) and EU Digital Services Act disclosure guidelines.

12.2 User Comments

Users are solely responsible for their comments. Offensive, defamatory, or illegal content will be removed, and IP addresses may be blocked.
Anonymous comments or false identities are not accepted.
IP data are stored solely for security and anti-fraud purposes, in compliance with LGPD and GDPR.

13. Lawful Use

By using our website, you agree:

  • To act lawfully and in good faith;
  • Not to use our content for commercial gain or fraudulent purposes;
  • Not to interfere with the security or functionality of our systems.

14. Privacy and Data Protection

We comply with the Brazilian General Data Protection Law (LGPD), the EU General Data Protection Regulation (GDPR), and other applicable privacy laws.
Your data is used only to manage your booking and communicate relevant offers. For more details, please refer to our Privacy Policy.

15. Disclaimers and Liability

a) We are not liable for injury, loss, accident, delay, or other damages resulting from circumstances beyond our control (e.g., weather, strikes, government actions, war, or force majeure).

b) We make reasonable efforts to maintain accurate website content but do not guarantee it will be error-free or uninterrupted.

c) This agreement is governed by the laws of Brazil, without prejudice to mandatory consumer protections applicable in your country of residence.

d) Where consumer laws apply (such as the Brazilian Consumer Code – Law 8.078/1990), our liability will be limited to the re-performance of services or reimbursement of equivalent value, except in cases of fraud or gross misconduct.

16. Third-Party Suppliers

We work with independent providers (guides, transport companies, hotels, etc.).
While we select partners carefully, we are not responsible for their actions or omissions.
Their own terms may apply and limit liability.

Any dispute between you and a third-party supplier must be resolved directly with them.

18. Updates

We reserve the right to update or modify these Terms & Conditions at any time. The latest version is always available on riodejaneirobycariocas.com and supersedes previous editions.
